Stolen from by EBook Tree

I posted this to my journal, but since I found my works and works from kaige68, haldoor, and sharpiesgal on the site, I thought I would share this with the community as a whole.

This was brought to my attention by luckweaver and yes, I found my stuff and stories belonging to everyone I have listed. Pass the word along.

Warning, and subsequent advice, originally posted here:

We’ve been getting pings and @’s all morning about ebooks-tree.com who seem to be scraping/taking stories off of AO3 and hosting them as PDFs and mobi downloads on their site; the site seems to be pulling from UrBookLibrary as well. They’re not reading your “do not copy/duplicate” notes on your AO3 fic; their bots are pulling things directly from AO3, without AO3′s authorization or assent. It looks like they are pulling from Wattpad too, again without authorization or assent.

While the Ebooks-Tree DMCA page seems to imply that you need a lawyer or other “authorized person” to submit a takedown notice, you don’t; you can do it yourself.

As we’ve posted before, fanfic writers hold copyright in their stories, although not in lines/quotes from the works they’ve been inspired by, and because of that, fanfic writers can submit DMCA takedown notices, or have someone do it on their behalf. While this post isn’t legal advice (none of our posts on FYC are), you might want to consider using this template (well, the bolded bits) in telling ebooks-tree to take down your content:
Your Name and/or Pseudonym as an e-signature (or the name of the person you’ve authorized to submit this request, with a slash before it and after it)
Link(s) to the unauthorized works (link to the pdf, the mobi and the page hosting all of it)
Link(s) to an authorized version of your work (whether on AO3, tumblr, LJ or somewhere else)
An email address of the submitter (include it again even if it’s in the header)
This statement: I have good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
This statement: The information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

tumblr user besinaao3 offers us this advice:

My name is [name] and I am the author and owner of the following works:
• “title” by “author”
• “title” by author

These are my intellectual property. I do not give you or anyone else permission to offer these works for download, and I did not consent for them to be available on your website. I am requesting that you remove them immediately. I can be reached by e-mail at [e-mail].

This information is accurate, and under penalty of perjury, I am authorized to act on my own behalf as the owner of this material.

Cut and paste that into their contact form and make sure that you make the subject line read: “DMCA Complaint” or they won’t process it.

you can also send an e-mail to their host: Response from Moniker: The best way to handle that is to contact our abuse team at abuse@moniker.com. They will be able to assist you or point you in the correct direction for legal matters such as this. This chat line is not equipped to handle matters of a legal nature such as this.

Extra warning: I don't feel I should need to say this, but please, do not download anything from the Ebooks-Tree site and do not give out your credit card information.

April 14 Update: (Information collected from iulia_linnea)

Please be advised that Ebooks Tree's URL no longer ends in .com (ebooks-tree.com); it now ends in .net (ebooks-tree.net). Further, ebooks-tree.com now redirects to ebooks-tree.net. I believe that this change may have been made by Ebooks Tree to avoid having to take down stolen material, which means that in order to have stolen material removed from the site, one needs to submit a DMCA complaint letter to abuse@moniker.com (Moniker is Ebooks Tree's hosting site) with the altered links to one's works.

When I search for my name, I no longer find any works listed for me on an author's page. Though Iulia still get the link to the 'full version' on her check and takes her to the sign up gimmie your credit card information.

I agree with her, the site is more than a little hinky and full blown stinky.

Thank you for this. I have just checked and found some of mine as well. I've sent them the message and will wait and see what happens. Fuckers.
Apr. 13th, 2015 11:09 pm (UTC)
They have published authors as well.

Thanks. Found some of my stuff as well. What the hell makes them think that it's ok to just steal people's stuff?
Apr. 13th, 2015 11:52 pm (UTC)
I don't know. It's sad how much stuff they have taken. Even if the credit the Author, it is still theft because we did not give them permission.

I have informed Anne Rice and JK Rowling that their books are up to read for free. Wonder how long the site will last. *Wicked Grin*

What the... I don't even have words! They've stolen words! STOLEN WORDS! I am so very not cool with the misappropriation of words.

Thanks, hon.
Apr. 14th, 2015 01:10 am (UTC)
You're welcome. Sorry your words were stolen as well.

they have 50 or so of my stories there as well. Guess when I'm not so tired and can think straight I'll be sitting down and dealing with them.

Apr. 14th, 2015 01:12 am (UTC)
Ouch, they only have 19 of mine, but it is enough of a headache. Sleep well.
Apr. 14th, 2015 12:51 am (UTC)
I'm going to use this post as a signal boost on my journal, I hope that's alright! This is ridiculous! Thanks for sharing.
Apr. 14th, 2015 01:13 am (UTC)
Be my guest. The more people who know, the more they can protect their works.

*rubs back* I do believe that the site will get into big trouble. Not just from Fan fiction Writers, but published authors as well.
Apr. 14th, 2015 01:44 am (UTC)
HOLY SHIT LIKE 20000000 of my works winded up on there fucking place. thanks for the advice
Apr. 14th, 2015 02:15 am (UTC)
*Winces* ouch. Sorry they stole from you and glad I could help.
Apr. 14th, 2015 01:49 am (UTC)
I just checked and I was shocked to find they have 22 of mine! I can't believe... what makes them think this is okay?

I've sent a complaint.
Apr. 14th, 2015 02:19 am (UTC)
I think they are idiots. Suicidal idiots. You do not offer up fan fiction without notifying the author; and you sure as hell do not offer published works (from people people like Rowling, Martin, Rice, Brust...) for free!

I hope they take down your stories and everyone else's that they have stolen.

A Birthday Post!
User peppermint_wow referenced to your post from A Birthday Post! saying: [...] and a bunch of other people's fanfic, but hey, what's a little honest plagiarism between friends? [...]

Ten of mine are in there - a weird mishmash of stuff, not necessarily the better of them at all. Very odd. I can say that the AO3/OTW folks were discussing it and put out a post on their own sites saying they are deciding whether to approach the matter on behalf of writers. Part of me hopes they do - certainly would be better than individuals having to approach it one at a time.

This isn't unusual in the web world - the commercial news web site I manage often has its headlines scraped by 'aggregator' sites. Each one needs to be fought off and beaten down. Eventually they give in.
Apr. 14th, 2015 03:41 am (UTC)
They have 19 of mine. They pulled my first story (which is crap) and a wide selection of fandoms and ratings from me. I hope AO3 approaches them and that the published authors like Anne Rice and L. Ron Hubbard (Scientology is scary) take offense.

Ugh, four of mine reported. I take solace that they've taken some FAMOUS people's stuff cause if there's one person's wrath I don't want coming down on my head it's Anne Rice, LOLOLOLOL.
Apr. 14th, 2015 06:15 am (UTC)
Yeah, Anne Rice and Scientology (Since L. Ron Hubbard's works are on there too.) Two of the scariest entities in the literary scene. *shudders*

Hopefully they will take down the stories soon.

Apr. 14th, 2015 08:13 am (UTC)
Thank you! I'm not in the author list, but put myself in the search bar and they have five of my fics. Utterly ridiculous.

eta: decided to go back and check under elle andrews patt as well and while it says 0 books, it has a download titled elle andrews patt.pdf (full version). Of course, I didn't download, but what the hell???

I was hoping that the site would have disappeared by the time I woke up.

Sorry you got caught up in all this headache of a mess. We can only hope that the site will be taken down since they are NOT in compliance with New Jersey's copyright law, as they have suggested.
Apr. 14th, 2015 11:17 am (UTC)
Jeez, this is crazy. Look how many of us have been affected! Thank you so much for pointing this out - I had thirty works there, and such random ones it wasn't funny (only parts of some full stories in some cases due to posting in parts instead of chapters, I suppose). I've sent them an email too, same thing - asking them to take my works down.

Let's hope this is over very soon. Thanks again.
Apr. 14th, 2015 02:27 pm (UTC)
So many and the company's bots were so random.

I am certainly hoping that it is over soon. They are giving me indigestion.
